These terms cover PotHead: Escape the Cloud (“PotHead”), the game for iPhone, iPad, Apple TV, and Android, and this website, potheadgame.com. Both are made by Edibu LLC (“we”). By playing PotHead or using this website, you agree to these terms.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to play PotHead on devices you own or control, for your own entertainment.
- On the App Store, Apple’s Licensed Application End User License Agreement governs this licence. These terms add to it, and if they ever conflict, Apple’s wins.
- On Google Play, Google Play’s terms of service apply alongside these terms.
You may not copy, sell, or redistribute the game; reverse engineer it, except where the law allows; or use it to break the law. The game, its characters (PotHead, NumNuts, and the rest), its art, music, and text belong to Edibu LLC or its licensors. Open-source parts and their licences are listed on the credits page in the game’s Settings.
A parody
Totally Safe AI is a fictional AI. The game’s companies, products, and slogans are parody and don’t refer to real ones.
Ads and purchases
- On iPhone, iPad, and Android, the game shows ads from Google AdMob between runs, as the privacy notice describes. Advertisers are responsible for their ads, and we don’t endorse them.
- Any purchases, such as “Remove ads” where it’s offered, are made and refunded through the App Store or Google Play under their terms. A purchase is tied to your store account and can be restored in Settings, Restore purchases.
Leaderboards
From version 1.1, the game has leaderboards on Apple’s Game Center (iPhone, iPad, and Apple TV) and Google Play Games (Android), when you’re signed in to them. They’re optional.
- Their services, their terms. Game Center is one of Apple’s services, under the Apple Media Services Terms and Conditions, and Play Games is part of Google Play, under the Google Play Terms of Service. Those terms cover your account there, your nickname or gamer name, and what the leaderboards show to other players.
- Play fair. Post only scores you earned by playing. Don’t use cheats, modified copies of the game, or other tools to change a score. Each leaderboard refuses scores outside what its level allows.
- No prizes. The leaderboards are for fun, and they have no prizes.
- They can change. We may reset, change, or remove a leaderboard, for example when a level changes, and Apple or Google may change their services.
The privacy notice explains what the game sends to Apple or Google, and how to stop.
Your progress
Your progress is saved only on your device. We can’t recover it if the app is deleted or the device is lost or reset. Scores you’ve posted to a leaderboard stay on Game Center or Play Games, but the game doesn’t restore your progress from them.
Changes to the game
We may update PotHead, add or change levels and features, or stop offering it. We’ll keep these terms and the privacy notice up to date as it changes.
No warranty
PotHead is provided “as is”. To the extent the law allows, we make no promises that it will be free of bugs or always available, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limits on liability
To the extent the law allows, Edibu LLC isn’t liable for indirect, incidental, special, or consequential damages from using PotHead or this website, and our total liability won’t be more than what you paid for the game in the past 12 months. Some places don’t allow these limits, so they may not apply to you.
The law that applies
These terms are governed by the laws of the State of Florida, USA, except where the law of the place you live says otherwise.
Changes to these terms
If we change these terms, we’ll update this page and its date. Playing after a change means you accept the new terms.
